Asbestos, The Duty to Manage
The Duty to manage asbestos was introduced in 2002 under Regulation 4 of the Control of Asbestos at Work Regulations 2002, this regulation, and it's requirements has been retained in all subsequent asbestos regulations up to the present day (CAR12).
Who does it apply to?
Quite simply, if you are the Duty Holder of any non-domestic premises in the UK that was built before the year 2000, Regulation 4 will apply to you.

Also included under 4 Reg. 4 are Duty Holders who have premises where there are communal areas of domestic premises, so premises with areas such as communal hallways, lift shafts, bin stores, plant rooms etc.

What do you need to know and do?
The first thing to do is to find out what asbestos containing materials (ACMs) you have, this may require an asbestos survey, or historic building documents. site based knowledge and experience, basically, know what you have, where it is and how much you've got.

Once you have this information, now it's time to manage it.
​
Look at the condition of your ACMs, who may disturb it, how often, doing what, basically, evaluate the risk.
